Welcome to DMSpree (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our Instagram outreach automation extension (“Extension”). Feedback: Any feedback, suggestions, or ideas you provide regarding the Extension are non-confidential and we may use them without any obligation to you. You grant us a perpetual, irrevocable, royalty-free, and transferable license to use, modify, and distribute any such feedback.
Termination by Us: We may terminate or suspend your access to the Extension at any time, with or without cause, including if you violate these Terms. Upon termination, your license to use the Extension will cease immediately.
Termination by You: You may discontinue your use of the Extension at any time. Termination does not relieve you of any obligations under these Terms that by their nature should survive termination, including but not limited to intellectual property rights and indemnification.
Disclaimers: The Extension is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Extension will be uninterrupted, secure, or error-free, and we disclaim any warranties for fitness for a particular purpose, merchantability, or non-infringement.
Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or related to your use of the Extension, even if we have been advised of the possibility of such damages. Our total liability for any claims arising from or related to your use of the Extension will not exceed the amount you paid to use the Extension.
You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Extension or any violation of these Terms. This indemnification obligation will survive the termination of your use of the Extension and these Terms.
We may update these Terms from time to time to reflect changes in our practices, the Extension, or legal requirements. We will notify you of any significant changes by updating the effective date at the top of these Terms. Your continued use of the Extension after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed about your rights and obligations.
Entire Agreement: These Terms constitute the entire agreement between you and DMSpree regarding the use of the Extension and supersede any prior agreements between you and us relating to your use of the Extension.
Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
